Online Bookshop Terms & Conditions

Your order is subject to the following terms and conditions (unless you have made special arrangements directly with us). These may change from time to time, but your order shall be subject to the version of the terms and conditions on this Website when you place your order. Pearson offers a range of online products and services. These terms and conditions apply to all online products and services in addition to the terms shown at their respective sites. If there is a conflict, the respective sites terms shall take precedence. Some subscription products are offered in different versions, or as a menu consisting of components that you may select. In this case, the prices and conditions are as set out in the specific terms. In the event that you require us to provide any additional training and/or consultations or additional content packages, you agree to pay for these at our then current rates; and they will be subject to the respective terms and conditions (as amended from time to time).

  1. Your order

    We will do our best to fulfill your order, but we cannot guarantee it. Where we make the product available to you through a third party fulfillment provider, we may provide you with an electronic redemption code that will allow you to download the product from the third party site. The third party site may require registration and may require you to accept their terms and conditions, which will apply to your use of the site and our product through it. The electronic redemption code will not be valid for redemption indefinitely. You should redeem it as soon as possible after receiving it, and you accept that it may expire if you do not redeem it within 30 days of reception. Each individual purchase is for use only by the person who bought the item.

  2. Price

    The prices are as stated from time to time on this Website and are subject to change without notice. If there are any post and packing charges, these will also be indicated separately on the invoice you will receive on supply/with the goods or on your digital receipt. The price stated on our Website is inclusive of any applicable value added or other sales tax. We will show a breakdown of sales or value added tax (as applicable) applied to the whole order in your invoice and on the purchase summary page before you confirm your order. We have no control over whether your bank will charge you any transaction fee or any other fee. You are responsible to pay any such fees and we are not liable for them.

  3. Payment

    All credit/charge card payments are subject to authorization by the card issuer. If your payment is not authorized, we will cancel your order (and notify you that we have done so). Online resources or digital files for download, or similar services, will only be made available to you once your payment has been authorized, unless we have agreed credit terms with you.

  4. Cancellation and Returns

    By submitting your order, you agree that we may process your order and begin the service immediately. If you are a consumer, you have a statutory right to cancel your order and obtain a refund, but this is subject to the following condition: 1.You may only cancel your order for a refund if you have contacted Pearson within 7 working days after you have completed your online purchase and have not redeemed the code/downloaded the file. Please notify the Customer Service team at elibrary.access@pearson.com if you wish to cancel your order, or to request a refund for a product or service. If you are unable to complete the download process or wish us to provide a replacement for a file that is defective, please contact our Customer Service team at elibrary.access@pearson.com .Where this is due to our default, we will replace or refund the download. Where we use a third party fulfillment provider to give you access to a product, we may direct you to their customer services team.

  5. DRM

    You acknowledge that all our electronic products such as eBooks include security technology, which ensures that they may only be used in accordance with the applicable license rights and can be accessed with compatible players only. All eBooks purchased on this site are encrypted using Hurixs proprietary Kitaboo DRM mechanism. Upon your download of a Digital Content, you are responsible for any loss, damage, or deletion of that Digital Content, and eLibrary Access shall have no liability to you for any loss, damage, or deletion of that Digital Content. You grant eLibrary Access the right to disable access to any Digital Content or remotely remove that Digital Content from your User Account and expressly consent to such disablement or removal, provided that eLibrary Access will not exercise such right unless (a) you return the applicable Digital Content, (b) you breach this Agreement, or (c) eLibrary Access determines that such Digital Content may create liability for, or harm to, you, eLibrary Access, or any third party. In the case of (a) or (c) above, your sole and exclusive remedy will be a refund of the Digital Content price. Subject to the terms and conditions of this Agreement and the payment of all applicable fees for the Digital Content, eLibrary Access grants you a non-exclusive, non-transferable, revocable license to download and use each Digital Content in accordance with the Usage Rules posted on the eLibrary Access Store solely for your personal, non-commercial or educational purposes during the period designated for such Digital Content on the eLibrary Access Store. Additional terms relating to the Digital Content may be posted on the eLibrary Access Store. Usage Rules may include limitations on the rental period, your ability to cut, copy and paste, or print portions of a Digital Content, the number of applications from which you can access a Digital Content, geographic territories, and reading aloud functionality. You will not: (a) transmit, modify, publish, sell, rent, lease, loan, distribute, license, or otherwise transfer any Digital Content or any portion thereof or rights therein; (b) display, perform, or reproduce any Digital Content except as permitted herein; (c) remove or modify any proprietary notices or labels on any Digital Content; or (d) bypass, modify, defeat, circumvent, or tamper with security or digital rights management features that protect or limit access to or use of any Digital Content. Restrictions:You will not: (a) permit any third party to access or use our products and services using your User Account (other than your child or your School Student as applicable); (b) rent, lease, time-share, loan, sell, license, or transfer our products and services to any third party or exploit our products and services for commercial purposes, save and except as per the terms of this Agreement; (c) interfere with, disrupt, alter, translate, or modify our products and services or any part thereof, or create an undue burden on our products, services and/or the networks; (d) reverse engineer, decompile, disassemble, or reverse compile our products and services; or (e) introduce software or automated agents or scripts to our products and services so as to produce multiple accounts, generate automated searches, requests and queries, or to strip, scrape, or mine data from our products and services. Availability and Modification of our products and services:eLibrary Access reserves the rights, from time to time, to suspend, modify, or discontinue any products and services, in whole or in part, with or without notice. You agree that eLibrary Access will not be liable to you or to any third party for any modification, discontinuance, or suspension of such products and services, in whole or in part. Feedback:By providing comments, suggestions, and other feedback relating to our products and services, applications, our business, products and/or services (collectively,Feedback) to us, you grant to us an irrevocable, non-exclusive, royalty-free and fully paid, worldwide, transferable license, with the right to sublicense through multiple tiers, to reproduce, distribute, modify, publicly display, publicly perform, prepare derivative works of, transmit, and otherwise use and exploit such Feedback, in any format or medium now known or developed in the future, for any purpose and in any manner. We will have no obligation to compensate you in connection with any Feedback. Third Party Websites:Our products and services may contain links to Internet sites and services maintained by third parties. We do not control, operate or endorse in any respect information, products, or services on such third-party sites and are not responsible for their content. Many third-party sites and services have their own terms of use that differ from ours. This Agreement only applies to our products and services and do not apply to any other site or information, products, or services on such sites. Third Party Applications:We may allow third parties to develop applications for use on our applications and to provide services for use with such applications (Third Party Apps). You agree that no Third Party App is subject to the terms and conditions of this Agreement. Instead, each Third Party App is licensed under the terms of the end user license that accompanies it. We are not a party to that end user license, and the Third Party App developer is exclusively responsible for that Third Party App and any associated warranties. Release:You hereby release us from any and all claims or liability related to: (a) any content posted on our products and services; or (b) the conduct, whether online or offline, of any other user, (c) third party websites, and/or (d) Third Party Apps and/or services.

  6. System requirements

    By submitting your order, you agree that we may process your order and begin the service. We will process your order upon receipt, but we do not guarantee immediate response or availability of service. You are responsible for all hardware, software, network availability and Internet connectivity required to access and/or use the product. We will provide you with a specification of the hardware and software required to use a product on request.

  7. Permissible Uses

    The following terms apply to software and other electronic products ordered through our Website, except where we provide access to the product through a third party fulfillment provider. In that case, the terms of use of the fulfillment provider will determine how you can use the product and those terms may be different from these below. YOU MAY -Download a product if you purchase the right to do so from us. -Subject to the terms of any third party fulfillment provider (where applicable), use a copy of the product on up to two devices (such as a computer, mobile device, tablet or other device) at the same time. If this device is linked to a network then the product may only be installed in a manner such that it is not accessible to other machines on the network. -Subject to the terms of any third party fulfillment provider (where applicable), transfer the product from one device to another, provided that you only use it on up to two devices at any one time. YOU MAY NOT -Re-sell, distribute, forward, rent or lease the product or any part of it. -Use the product on more than the allowed number of devices. -Make changes to the content of any product except where we expressly allow you to do so, and then only to the extent that we have permitted. All content and software supplied to you through this Website is our property, or that of our affiliates, or of third parties who have granted us rights and it is protected by Indian and international copyright laws.

  8. Discontinuation of Service

    We may decide to discontinue this Website, or any part of it, or make substantial changes to it at any time without notice. We are also not obliged to provide all support services indefinitely.

  9. General

    Although we try to ensure that the information we provide on our Website and in our products, goods and services is correct, it is provided on an 'as is' basis, without warranties or representations of any kind. No warranty, representation, conditions or other term, express or implied, is given that any of the content is accurate, complete or up to date. eLibrary Access or Pearson does not accept any liability for any error or omission of any content on this Website, in any product, goods or services, including content provided by us or any affiliated entities or by any users or other third parties. We do not make any representation, or give any warranty or undertaking; and to the full extent permissible by law we expressly exclude any and all representations and warranties whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and correspondence with description, or of the products/services not being defamatory, injurious, obscene or unlawful or of non-infringement of any intellectual property or other third party rights, whether implied by statute, common law, custom, trade usage, course of dealing or otherwise. We do not exclude any liability in respect of death or personal injury caused by our negligence, liability for our fraud, or any other liability that we cannot exclude by law. We cannot guarantee and do not promise any specific results from use of any product, services or goods sold through this Website. We will have no liability to you for any failure to deliver goods or services you have ordered, or any delay in doing so, or for any damage or defect to services or goods delivered that is caused by any event or circumstance beyond our reasonable control. Use of this Website and anyproduct or service ordered through it and any content on any part of it, whether requiring registration and/or subscription, or not, is at your own risk. eLibrary Access or Pearson will not be liable to any users of this product (whether registered users, subscribers or not) and any third parties for any claims or losses of any nature including, but not limited to, loss of profits, direct, indirect, special or consequential damages arising from a users or third party's use or inability to use any product or service or any part of it, including any loss of data or lost profits or wasted time of management or employees - even if eLibrary Access or Pearson is aware of or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained in these Terms of Use, eLibrary Access or Pearsons liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us. If, for any reason, part of these terms and conditions is unenforceable the validity of the remaining terms and conditions shall not be affected. You are not permitted to remove or amend any trade mark, copyright or other proprietary notice on any of our products. You acknowledge that all rights in and to any and all copyrights, knowhow and other intellectual property rights relating to our products are and shall remain our property (or that of our licensors). You will not at any time do, or cause to be done, any act or thing which impairs or infringes those rights. These terms and conditions and all contracts under these terms and conditions are governed by and shall be construed in accordance with the laws of India and all disputes shall be submitted to the exclusive jurisdiction of the Delhi courts.

  10. Promotions

    • Offer is valid from 1st June to 15 July 2018

    • Under no circumstances, the offer shall be settled in cash
    • Order placed during this promotion can't be returned or refunded
    • End User/Customer hereby agrees to indemnify and keep Pearson harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorneys fee) that may be suffered by Pearson as a consequence of (i) violation of these T&C; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence, by the End User/Customer.
    • This Offer is subject to applicable law and regulations and would be modified/discontinued based on the prevailing law /regulation at any point of time and neither party shall be under any liability or obligation or continue implementation of the said Offer till such time the terms are modified by the Pearson as per the prevailing/ amended law at that point of time. In the event, that the Offer cannot be continued without total compliance of the prevailing law at any point of time, this Offer shall be deemed to be terminated forthwith from the date when the amended law restricting/prohibiting the Offer comes into force.
